Domestic battery enhancement Indiana SB 79
The House Courts and Criminal Code Committee heard SB 79 sponsored by Rep. McNamara regarding domestic battery enhancement. The author, Sen. Crider, introduced the bill which enhances the penalty for domestic battery when the offender has a prior conviction for strangulation against the same family or household member. Amendment 2 was adopted by consent to enhance the penalty for an offender who re-offends against an individual that currently possess an active protective order or no-contact order against the offender. Amendment 3 was adopted by consent to give schools notice and allow schools three days to respond to a protective or no-contact order between minors that may interfere with the school’s ability to provide in-person education to those minor students. The amendment does not interfere with the court’s ability to immediately enter the no-contact or protective order. The Indiana Prosecuting Attorneys Council and the Indiana Coalition Against Domestic Violence testified in support of Amendment 2. The amended bill passed 11-0.
